Texas Couple Files Suit against Truck Driver, Company after Accident

According to police reports from the April 8 incident, Roberts drove through a stop sign and struck a pickup driven by Peggy Sue Thompson, 50, and carrying her two grandchildren, Aubrey Nicole Moore, 6, and Dylan Glenn Moore, 10. Thompson and Aubrey died of injuries sustained in the crash, while Dylan remains in a coma in a Fort Worth intensive care unit.

Following the incident, Roberts told police that he was is a rush and was talking to his dog when the crash took place. During their investigation, police officials determined that Roberts' truck had four improperly adjusted brakes.

The Moore's suit seeks unspecified damages for the deaths of Thompson and Aubrey, as well as unspecified damages for medical bills stemming from Dylan’s injuries. The suit claims that negligence on the part of both Roberts and Swinson Excavating contributed to the accident.
