Wilhoit notified the Hyatt Regency San Francisco after suffering the accident, and said that he decided to file the lawsuit after speaking with his attorney about the fall. In the lawsuit, Wilhoit blamed the accident on the hotel’s failure to provide a mat in the shower of his room.
The lawsuit stated that Wilhoit was in the shower of his hotel room at the Hyatt in Burlingame, near the San Francisco International Airport on July 18, 2006, when he fell with enough force to cause him to fall out of the tub and onto the bathroom floor. The accident happened the day before Wilhoit and his fiancée left for a nine-day cruise.
Wilhoit said that he suffered a painful shoulder injury that has affected him for almost a year. He underwent surgery on Dec. 11, 2006, to attach a torn tendon in his bicep and treat his right rotator cuff. During his recovery, he had to wear a sling, ice his shoulder, and sleep in a reclining chair.
Wilhoit was named the 2006 Stocktonian of the Year and is credited with promoting tourism and business in Stockton. The lawsuit does not specify how much Wilhoit is seeking in damages.
