Boy, 11, Killed by Underage Driver; Parents Sue

Fabian Saenz was killed when a car driven by a 15-year-old girl spun out of control and struck him as he was mowing the lawn in front of his house. According to Tulsa police, the girl was driving approximately 60 miles an hour in a 25 mile an hour zone. She was in the car with multiple underage passengers.

The teen's aunt, Rebecca Warren, was sentenced to a four year prison term for allowing her niece to drive the car. The girl has been charged as a youthful offender with second-degree murder. Lawyers on both sides have agreed to try her case in juvenile court.

Saenz's parents, Armando and Guadalupe Saenz, are suing Alfreda Bagby and Keith Warren, the parents of the driver. Their lawsuit claims actual and excess damages of at least $10,000, according to a filing in Tulsa County District Court. No court date has yet been set.

Fabian was my sons ( Eddie) friend and classmate at Roy Clark Elem. He wrote my son a letter before their trip to exchange city. The letter was dated 8/30/05. I kept the letter and found it today 10/13/10, I just felt so sad for his parents when I look at my son who is now 16yrs old. I can't imagine their pain. All I can do is just pray for them, may God bless them. Carol
