Lovinggood lost control of his truck, hit the guardrail, and collided with a concrete post before breaking through the guardrail and landing in the lake. He died of massive head injuries.

Beneficiaries of the two suits include Lovinggood's father, mother, and aunt. The first suit, a wrongful death claim, alleges that negligent bridge maintenance caused Lovinggood's death. The wrongful death suit asks for damages to cover economic loss, mental shock and suffering, wounded feelings, grief and sorrow, and loss of companionship, among other claims. The second suit asks for additional damages for the pain and suffering experienced by Lovinggood during the accident.

According to the family's lawyer, the bridge has been the site of numerous accidents, including at least one involving a fatality. The lawsuits allege that the county was aware of substandard bridge railings for some time, but failed to repair them. Anderson County legal and administrative officials could not comment on the suit.
