Taisuke Matsuo, 66, was apparently stricken by a heart attack during the flight from Tokyo to Chicago. The lawsuit, filed by his wife, alleges American Airlines was negligent and seeks approximately $150,000 in damages.

Matsuo’s body was found after the plane landed at O’Hare International Airport on April 13, 2005. When the passengers and crew had left the plane, a cleaning crew stepped in to clean it for the next flight. The body was found inside a lavatory, locked from the inside, two hours after the landing.

A spokesman for American Airlines said the company does not comment on litigation currently in process.
