The lawsuit, filed by Alison Sikora, 22, names the Town of Newtown, the United Fire Company of Botsford, and Brian McNeill, 25 - the driver of the truck - as defendants. Sikora is seeking unspecified damages greater than $15,000 to compensate for injuries, consequential loss, and expense. According to the lawsuit, she sustained a variety of injuries, notably to her neck and back.

The fire truck struck Sikora's sedan from behind as she was waiting for traffic to clear in order to turn left into a parking lot. Following an investigation, police warned McNeill that he had been following at an unsafe distance.

In the lawsuit, Sikora claims that McNeill was negligent in nine ways. According to Sikora, McNeill was driving too fast given the width of the road and traffic conditions at the time, and that he was following too closely given traffic conditions at the time. According to the suit, Sikora has incurred medical expenses associated with the incident.
