Seaman Files Benzene Lawsuit in Jefferson County

Cancel was a seaman for 25 years aboard the defendants' vessels used to transport chemical substances to and from refineries.

He was diagnosed with mantel cell lymphoma in February 2007.

From 1980 to 2007, his petition alleges, he was needlessly exposed to benzene and benzene-containing substances.

Cancel's suit claims that the defendants are liable for negligence and guilty of fraud since they knew exposure to benzene is a serious health risk, potentially causing life-threatening illnesses, but nevertheless did not prevent needless exposure to the carcinogenic substance.

Cancel is seeking damages for medical expenses, physical pain and suffering, mental anguish, and loss of wages. Suzanne Cancel, his wife, is seeking damages for loss of companionship and mental anguish from observing her husband's condition.

Attorney Randall Collins is representing the Cancels. They are demanding a trial by jury.

Judge Donald Floyd will preside over the case in the 172nd Jefferson County District Court.
