Texas Woman Sues City after Fall

The lawsuit, filed on May 10 in a Texas District Court, claims that Norma Kuykendall left a local business establishment and was walking toward a ramp that would allow her to access the street when she fell off of an angled step-off that, according to the lawsuit, was not a normal or expected feature.
According to Kuykendall, who suffers from osteoporosis, she did not anticipate the step-off and subsequently fell down the ramp, breaking both of her legs. She underwent six weeks of therapy before her insurance stopped payment on her claim. She still requires the assistance of a crutch or cane when she walks, and may need to undergo bone stimulation treatment.
In her lawsuit, Kuykendall claims the city was negligent for failing to post warnings or markings identifying the potential hazard. In addition to Waxahachie, the suit names Lindsey Contractors Inc., which was responsible for the design and construction of this particular step-off.
