The family of Lottie Chubinski filed the lawsuit against Manorcare at South Holland Nursing Home. Chubinski stayed at the nursing home between June 9 and Sept. 28, 2001, after she fell and injured herself at her home.

According to family attorneys Steven Levin and Michael Bonamarte IV, during her stay at the facility Chubinski suffered severe bed sores and was malnourished and dehydrated due to staff neglect.

Although family members made a number of complaints to the facility's staff, Chubinski's condition worsened, the attorneys said. According to the lawsuit, one of the sores was so severe that Chubinski developed a blood and bone infection, preventing her from being able to walk or receive physical therapy. She died in November 2001 at age 86.

Levin said Chubinski's situation was a clear-cut example of nursing home neglect. Manorcare lacked adequate staff and failed to properly train and supervise its employees, he said.

Cook County Judge Lynn Egan approved the settlement last month.

An attorney for Manorcare acknowledged the settlement, but would not comment further on the case.
