Mercy Flight Central, a service that transports critical patients to western and central New York hospitals, says state police and the local sheriff's department use their own helicopters to carry patients that its own company should be transporting.

The medical service company claims state police and the Sheriff's department is in violation of the Federal Aviation Act because they are not certified for emergency transports.

Mercy Flight Central's lawsuit is seeking a court order preventing the agencies from transporting emergency patients, as well as unspecified monetary damages.
