The plaintiffs - Joel, Evaline, Karen, and Billy Joel White – were driving behind the semi truck when it tipped and rolled. They stopped, and the truck exploded, leaving a crater in the road. According to the Whites' lawsuit, Evaline White was struck by shrapnel from the explosion, and the entire White family suffered significant hearing loss and mental distress as a result of the explosion.

The suit accused R & R Trucking, Inc. of recklessness loading the truck and training its drivers. The company publicly denied all charges, saying the White family's injuries were caused by other factors not controlled by R & R Trucking. The suit was settled for a confidential amount. In all, about 40 claims were filed by various motorists as a result of the incident, which took place on August 11th, 2005 on U.S. Highway 6.
