$1.6 Million Awarded in Illinois Medical Malpractice Case

The verdict is the second-largest award for medical malpractice in the county's history. Jurors delivered the verdict August 23, after deliberating for two days.
According to the lawsuit, between June and November 2003 David Kordek, 44, sought the care of Dr. Vijay Marwaha for frequent urination and other medical problems. Over time, Kordek's kidneys became blocked by a mass in his bladder, causing him to suffer renal failure – a condition in which the kidneys are unable to eliminate waste from the blood.
In November 2003, Kordek was diagnosed by another physician at Rochelle Community Hospital as having late-stage bladder cancer and renal failure. At that point, Kordek was limited in his treatment options, however, due to the delayed diagnosis, his attorney said.
According to trial testimony, Kordek has a 10 percent chance of living to age 50 because of his health problems. The jury ruled that Marwaha was negligent for failing to properly diagnose Kordek's condition.
