Medical Malpractice Case against Doctor, Hospital Set to Resume

Holly Schwanke gave birth to her son Carter at St. Cloud Hospital in November 2004 after days of labor. Carter was born with severe brain damage as a result of oxygen deprivation, and Holly and her husband claim that their son's injuries were the result of negligence on the part of the hospital and delivery room doctor George Schoephoerster. A delayed birth can cause a child to suffer asphyxia, which can result in brain damage.
According to court documents filed on behalf of the defendants, Schoephoerster denies that the injuries were caused by any negligent acts.
The trial is set to resume this week in Stearns County District Court, and is being tried before Judge Frank Kundrat. The case is expected to last two weeks or more.
