Family Files Lawsuit over Injury on Cruise Ship

Caden McCray is named as a defendant in an incident which occurred several hours after the cruise ship "Elation" departed from San Diego enroute to Cabo San Lucas. The lawsuit alleges that McCray assaulted Boney on the ship. Witnesses found Boney unconscious at the bottom of a stairwell near the rear of the ship.

McCray has not been charged with a crime; however he was confined to his stateroom after the incident. McCray says Boney had threatened and grabbed him, leading him to push back, which resulted in Boney falling down the stairs. The two men had not met before the incident.

The FBI questioned McCray when the ship arrived in Cabo San Lucas.

Boney remains in a medically induced coma at a San Diego hospital.
