Family of Brain-Injured Child Receives $26.5 Million in Malpractice Suit

Jose E. Bejarano Sr. and his wife, Maria, filed the lawsuit against Drs. Julie D. Miner and Alisa B. Goldberg of Brigham and Women's Hospital. The Bejaranos' 10-year-old son was born at the hospital with severe cerebral palsy, a condition that has left him restricted to a wheelchair and in need of constant supervision. The family claimed that during the delivery the doctors failed to recognize signs of fetal distress and perform a caesarian section birth in a timely manner, causing their son to develop cerebral palsy.

The verdict is the state's largest this year in a medical malpractice case The Bejarano family said they are happy with the result.

The defendants’ lawyer, Edward Hinchey, claims that the birth injury was not a result of negligence on his clients’ part, and is likely to appeal the decision.
