U.S. District Judge William Bertelsman said that he moved the trial up from December to August in an attempt to encourage Comair to settle with the family members who are part of the lawsuit.

After settling 15 lawsuits stemming from the crash, Comair ceased offering settlements, citing uncertainty as to whether the Federal Aviation Administration would be named as a defendant.

Comair Flight 5191 crashed into a field near Bluegrass Airport shortly after takeoff in August 2006.

The co-pilot was the sole survivor of the crash.
