According to Brian Chase of Bisnar Chase, the attorney for Jose Estrada and Rita Cruz Quintero, the fatal accident occurred as Estrada, Quintero, and other family members were returning from a family vacation.

On route to San Diego, a tire failed, causing Estrada to lose control of the vehicle. The van rolled over and landed on its roof, killing Jessica Estrada, the daughter of Estrada and Quintero.

The suit alleges that Ford knowingly used defective Goodyear tires and defective roof supports when designing and manufacturing the van. In addition, the vehicle lacked an electronic stability system, a safety measure that was available to Ford, the suit claims.

Estrada and Quintero are not allowed to disclose the amount they received, according to the terms of the settlement.
