The lawsuit, filed in U.S. District Court for the Eastern District of Missouri, claims that Maj. Stephen Stilwell was flying the F-15 at 18,000 feet over Missouri when it began to shake violently.

Stilwell ejected as the plan began to break apart and was hit by flying debris. According to his attorney, Morry Cole, Stilwell suffered injuries to his shoulder and arm.

Stilwell asserts that Boeing should have been aware of the defects in the F-15. Air Force officials inspected the fleet that Stilwell’s plane was part of and reported finding cracks in some of the parts that failed on Stilwell’s jet.

Boeing could not be reached for comment.
