Almost $3.6 Million Awarded to Victim in Subway Train Accident

A New York man has been awarded almost $3.6 million dollars for injuries he sustained in a subway train accident in April of 2006. The accident occurred at the 14th Street- Union Square station at approximately 1:50 AM on the morning of April 23rd.
The 25-year-old man had been drinking with friends and was intoxicated at the time of the accident. He had fallen onto the subway tracks when a train struck him and ran over his right leg.
Although the victim had a blood alcohol level of .18% and was determined to be partially at-fault for the accident, the jury found that the train operator was negligent for failing to stop the train in time after he noticed an "unknown mass" on the tracks while still over 180 feet away.
Because the operator had time to stop the train but failed to do so, the New York City Transit Authority was held liable for the victim's injuries. The victim was awarded a settlement of $3,594,943 for his medical expenses and for the pain and suffering caused from the loss of his right leg.
