Traumatic Brain Injury Victim and Family Receive $20 Million for Burger King Fall

The family of a boy injured at an indoor playground at a Burger King fast food restaurant in Temecula, California has reached a personal injury settlement for $20 million dollars. The lawsuit named Burger King, the franchisee, and Delta Marketing, Inc., the installer of the playground, as defendants.
The accident occurred in August of 2005 as the boy and his sister were playing on the indoor playground equipment at the Riverside County restaurant, about 60 miles from San Diego. The boy fell from the playground and hit his head on the hard tile floor. Even though the playground included a fireman's pole and monkey bars, no protective padding was installed beneath the equipment, according to court documents.
The boy sustained a traumatic brain injury and lung injuries as a result of the accident. According to his personal injury attorneys, he has since required extensive medical care, including a two-month stay at Children's Hospital in San Diego. Doctors, nurses, and therapists continue to try and help the boy, now 12, recover from his injuries.
