A Palm Beach County jury has awarded $2.3 million to a man who suffered injuries from an accident that occurred at an entertainment complex in Boca Raton. The victim, Michael Livingston, now 50, fell from a rock-climbing wall at Boomers in 2005 and sustained a broken ankle and several fractured vertebrae.
Livingston's accident was caused by the failure of a hydraulic cable attachment at the top of the rock-climbing wall. Attorney Stephen Le Clainche represented the plaintiff, a software developer from Boston.
According to Le Clainche, Boomers claimed that they had no obligation to test and maintain their equipment. Boomers is owned by Festival Fun Parks of California. The Boca Raton location is one of fourteen Boomers operated in California, Florida, and New York.
The Palm Beach County jury took only twenty minutes to decide their verdict at the conclusion of the four-day trial last month.
