New Jersey DUI Statistics

Being convicted of driving while intoxicated (DWI) in New Jersey can cost a lot more than in most other states. In addition to jail time, license suspension, participation in a rehabilitation program, and installation of an ignition interlock device (IID), New Jersey levies six separate fines on the offender. A first-time DWI offender can spend up to 30 days in jail, followed by two days in an intoxicated driver resource center, attending alcohol and highway safety education courses and undergoing an evaluation for alcohol or drug problems. The center may refer the offender to a mandatory 16-week treatment program. All resource center and program costs are paid by the offender.

A first conviction can also result in a three-month suspension of driving privileges.

Fines and Fees Could Total Up to $1,000

The basic fine for a first DWI conviction is from $240 to $400 for a BAC of 0.08 or higher and from $300 to $500 for a BAC of 0.10 percent of higher or DWI due to drug use. There is also an insurance surcharge of $1,000 for each of three years.

A fee of $100 each is charged for a drunk-driving enforcement fund, a Motor Vehicle Commission restoration fee, and an Intoxicated Driving Program fee. The Violent Crimes Compensation Fund fee is $50; the Safe and Secure Community Program fee is $75, and a $100 surcharge is split between the state and the municipality in which the conviction is obtained.

Some jail time, license fines and penalties increase for subsequent convictions.

IID Costs Also Paid By Offender

If an IID is ordered installed in the offender's vehicle, the costs of installation, rental, and periodic inspection are paid by the offender. The IID requires passing a breath test before the vehicle can be started.
