In some states, the circumstances under which the injured entered the premises may affect his or her ability to file a premises liability claim. When a premises liability accident occurs, the injured has a limited amount of time to file a lawsuit. This time limit is called a statute of limitations. Once this deadline has passed, the injured cannot file a claim.

In order to have a viable premises liability claim, you must be able to present compelling evidence that you were injured because of hazardous conditions on a premises and that the owner of the premises did not exercise a reasonable level of care to prevent the injury.
